Fanon into Canon?

So um, ah.... forgeworld named a product bundle after my homebrew Xth Legion Clan

It could just be someone at FW googling a Clan name and mine booping up miss-attributed as canon, but if not - holy :censored:

 

I'm incredibly flattered. Whether this means someone's just seen a fraction of my stuff and thought it was cool, or there's a FW staff member who frequents the forum, this is amazing in it's own small way.

 

I know it in no way makes Brannsar canon, but this is such a cool thing to happen.

Thanks everyone, this was a cool lil' thing to happen, especially at Christmas, considering I've been pretty inactive on here for a while

I thought they already put out some very similar designs to IHF's?

 

 

Not that I'm aware of? People have always said that there are folks at FW who keep an eye on my stuff, but the closest thing to that is the possibility that my idea for circuitry-design tattoos for Iron Hands Legionaries influenced the artwork of Autek Mor, which is entirely speculation

Ha, I wouldn't quite put it there, but it was a pretty cool thing to happen, and totally unexpected. I'm planning on applying for a concept artist position at GW sometime in March, so this might indicate my design style is in the right direction

Kudos to both you and FW for reading us and recognizing a great fan effort! That's a great community move that I can really appreciate.

And on the other hand, the author / writer / translator in me is jarred at they way they (didn't) handle that. that they did not even ask you for permission and used your intellectual property for their marketing. That's an absolutely :cussty business move you could easily sue them for and win. You have precedence on the name, you have rights, damn their corporate souls.

Likely the moment they find out, they will change the clan title, legal reasons of course, until then "internet fist bump" from fandom to Cannon...

I very much doubt there's any legal wrangling that could conceivably originate from this - 'brannsar' is of course just Norwegian for 'burn' :happy.:

Even if this is coincidental, even if this indeed is a common Norwegian word that fits the theme, the overarching context in which it was used (40k Marines of Clan Brannsar Iron Hands) has you as having precedence. Purely legally, you have the rights to this intellectual property.

Brannsår is Norwegian for burn injury (literally "burn wound").

 

I guess FW might be in line for a burn of their own.

 

EDIT: Could be someone from FW had seen OP's work, and then forgotten about it. Then, when trying to come up with a name, it returned without the connection being made.

It's really neat to think that GW might have some awareness of fan-created material and that they might incorporate it into the body of canon. This might be purely a coincidence, of course, but even if it is, congratulations.

 

I would caution against listening to the nonsense about owning any rights to the name or the ludicrous thought that you might be owed compensation. Your work is derivative of GW's original work; and as has been pointed out, it's not like the name was made up.

At least in the US (don't know much about international IP law, but I imagine it's largely the same in the broad strokes) a name on its own is not protected by IP law, unless it is used as a trademark to denote particular products or services of an individual or group, and he's not used it as a trademark so far as I know of, As far as I can see, the Clan Brannsar bundle bears no direct relation to IHF's masterfully creative inventions, but merely shares a name to reference products which FW and GW own the rights to in their entirety. I don't believe he has legal rights to the name, but a trademark lawyer could probably analyze such a thing more closely.

 

I almost forgot, though! Congratulations IHF! Awesome to see that FW still keeps an eye on the community, or seems to at least.

The name itself, though, is not IP. Like I said in my post, the only time a name can be protected under law is when it is used as a trademark, and they do not borrow from the particular ideas expressed in IHF's work and design either, merely using it in reference to their own products priorly established. That does not infringe on the copyright of his work. There's nothing in that Wikipedia article you linked to support your claim, either, so I'm honestly not sure why you linked it.

Took part in a big campaign organised online via Reddit called "The House of Cadmus". It started to falter a bit so I took it to my local group and we ran with it and finished it ourselves. A couple of years later the Imperial Knight with House Cadmus as the poster boys is released. We were delighted!

 

I own a nice sizeable Cadmus force now cause how couldn't it? I hope it was thanks to that initial organiser that someone at GW spotted the Cadmus name, such a cool link.

 

Hope yours is the same
