On the one hand, I don’t think the act of purchasing, or the state of having specific miniatures or properly printed rules (or even adhering completely to the rules) are what makes 40K 40K.
Otoh, if it doesn’t have the 40K aesthetic and feel, I would not call it 40K (and that will usually entail at least some GW minis). I don’t think it’s arbitrary so much as subjective, where the line is drawn and I don’t think the line can realistically be expected to be very clear. It’s a difficult, if not impossible, thing to quantify and there’s not any particular benefit to doing so, to my mind.

 

With all that being said, there are 3rd party miniatures which I would absolutely feel (subjectively, of course) do not fit the 40K aesthetic and tone - and so, they would make a game of 40K perceptibly “less 40K” to me.

 

The original question is still quite interesting to mull over, though.
